All capitalized terms used in this Fair Use Policy without definition will have the same meanings set forth in the Terms of Service available at [www.openphone.co/terms], into which this Fair Use Policy is incorporated.
- Unless otherwise indicated on an Order Form, Customer’s plan has a limit of three thousand (3,000) text messages per user for each calendar month, with the first month of the plan being based on the number of days remaining in the month during which Customer first signs up for the Services. For example, if the Customer has five (5) users under its plan, the Customer’s limit for its users collectively will be fifteen thousand (15,000) text messages.
- This limit does not apply to automated messages triggered through Zapier or OpenPhone’s API given those messages are charged per message.
- This limit also doesn’t apply to international messages as those are charged per message.
- This limit doesn't apply to direct messages sent amongst team members under the same Customer’s plan (“Workspace”) or messages sent to other OpenPhone users outside of the user’s Workspace.
- In the event that a Customer consistently exceeds the monthly limit, OpenPhone reserves the right, in its sole discretion, to assess an additional usage charge for that Customer of either $0.01 per text message in excess of the limit or OpenPhone’s then-current overage rate for each text message in excess of the limit.
- In the event that a Workspace sends more than three thousand (3,000) messages per day, that Workspace must register with phone carriers to avoid message filtering and will be responsible for any associated fees.
- To the extent commercially reasonable, OpenPhone will provide notice of a Customer’s usage in excess of the Customer’s limit.

- To the extent commercially reasonable, OpenPhone will provide notice of a Customer’s usage in excess of the Customer’s limit.
- Each user may use the Service on one (1) desktop or laptop computer and two (2) mobile devices (the computer and mobile devices collectively, the “Devices”). In the event that a user exceeds the number of Devices allowed, OpenPhone reserves the right, in its sole discretion, to automatically upgrade the applicable Customer’s plan to a plan that is appropriate for the number of Devices being used by its users.
OpenPhone may suspend, limit, or even terminate Customer’s access to the Service in accordance with the Terms of Service.
